<h3>Terms of Service</h3>
<p>These terms govern your use of toyshopnyc.com and any purchase you make from us. By using this site or placing an order, you agree to them. Please read them before you buy.</p>
<p>In these terms, "we", "us" and "our" mean ToyShopNYC, operating two retail shops in Brooklyn, New York, and this online store.</p>

<h4>1. Using this site</h4>
<p>You may use this site to browse our catalogue and place orders for personal, non-commercial use. You agree not to use it for any unlawful purpose, not to interfere with its operation, and not to attempt to access areas of the site you are not authorized to reach.</p>
<p>By placing an order you confirm that you are at least 18 years old, or that you are using the site with the involvement of a parent or guardian.</p>

<h4>2. Accounts</h4>
<p>You can order as a guest or create an account. If you create one, you're responsible for keeping your login details confidential and for activity that happens under your account. Tell us promptly if you think someone else is using it.</p>

<h4>3. Products, descriptions and availability</h4>
<p>We do our best to describe products accurately, including brand, contents, size and age recommendation. Age recommendations follow each brand's official guidance and applicable US safety standards. Colors and finishes may vary slightly from photographs, and manufacturers sometimes change packaging or assortment contents without notice.</p>
<p>Assortment items are sold as "styles vary" where noted — we can't guarantee a specific character or color from an assortment unless the listing says so.</p>
<p>All items are subject to availability. Our online stock and our in-store stock are linked, so on rare occasions an item may sell out between your order and our picking it. If that happens we'll contact you and refund you in full.</p>

<h4>4. Authenticity and sourcing</h4>
<p>We buy direct from brand manufacturers or their authorized US distributors. We do not source from third-party marketplaces or unverified resellers. Baby formula is sourced through authorized US importers, stored properly, and shipped with at least 6 months remaining before the expiration date.</p>

<h4>5. Pricing</h4>
<p>All prices are in US dollars and exclude sales tax, which is calculated at checkout where applicable. We may change prices at any time, but the price you see at checkout is the price you pay for that order.</p>
<p>We try hard to avoid pricing errors. If an item is listed at an obviously incorrect price, we reserve the right to cancel the order and refund you in full rather than fulfil it at that price. We'll contact you first.</p>

<h4>6. Orders</h4>
<p>Your order is an offer to buy. Our order confirmation email acknowledges that we received it; the contract is formed when we ship the item or mark it ready for pickup. We may refuse or cancel an order — for example where an item is unavailable, where we suspect fraud, or where a pricing error has occurred. If we cancel, we refund you in full.</p>

<h4>7. Payment</h4>
<p>We accept the payment methods shown at checkout. Payment is processed by Shopify Payments and the other providers listed there; we do not store your full card details. By submitting payment information you confirm you are authorized to use that payment method.</p>

<h4>8. Shipping and risk</h4>
<p>Shipping options, costs and timeframes are set out in our Shipping policy, which forms part of these terms. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery, or on collection in the case of in-store pickup — but if a parcel is lost or damaged in transit, contact us within 14 days and we'll make it right.</p>

<h4>9. Returns and refunds</h4>
<p>Returns and refunds are covered by our Refund policy, which forms part of these terms.</p>

<h4>10. Gift cards</h4>
<p>Digital gift cards are available from $10 to $500 and are delivered by email. Gift cards are non-refundable and cannot be exchanged for cash except where required by law.</p>

<h4>11. Intellectual property</h4>
<p>The content of this site — text, layout, our logo, our photography and our product descriptions — belongs to us or to our licensors and may not be copied or reused commercially without permission. Brand names, logos and product images belonging to the manufacturers we stock remain the property of those brands and are used here to identify their products.</p>

<h4>12. Your content</h4>
<p>If you send us reviews, photos, comments or suggestions, you grant us a non-exclusive, royalty-free licence to use them in connection with our business. You confirm the content is yours to share and isn't unlawful or offensive. We may edit or remove submitted content at our discretion.</p>

<h4>13. Third-party links</h4>
<p>This site may link to third-party sites — brand pages, warranty registration and similar. We don't control them and aren't responsible for their content or their policies.</p>

<h4>14. Disclaimer of warranties</h4>
<p>This site and its content are provided "as is". We don't warrant that the site will be uninterrupted or error-free. Products are sold with the manufacturer's warranty where one exists; beyond that, and beyond your statutory rights, we make no additional warranty. Nothing in these terms excludes any right you have under applicable consumer protection law.</p>

<h4>15. Limitation of liability</h4>
<p>To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.</p>

<h4>16. Product safety</h4>
<p>Follow the age recommendations and safety warnings on product packaging. Many toys contain small parts and are not suitable for children under 3. Adult supervision is required where the packaging says so.</p>

<h4>17. Indemnity</h4>
<p>You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.</p>

<h4>18. Governing law</h4>
<p>These terms are governed by the laws of the State of New York, and any dispute will be handled by the courts located in Kings County, New York.</p>

<h4>19. Changes to these terms</h4>
<p>We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.</p>
